			<content:encoded><![CDATA[<p>A man was killed in Orange County in June after getting out of his disabled vehicle on the freeway and being hit by another driver. The man, <a href="http://www.ocregister.com/news/struck-304204-quesada-killed.html">Lamont Palmer</a>, was hit by a passing mustang in the slow lane of the freeway after exiting his vehicle, probably to check the damage. And while further investigation is needed, there are several ways in which his family can seek compensation.</p>
<p>First of all, lets focus on the car itself. If the car was disabled for structural reasons or faulty manufacturing, then his family can file a wrongful death suit against the car company, seeking damages and emotional distress, as well as a few other things. Of course, if the car simply had a flat tire, that option would be out.</p>
<p>The family could also sue the driver of the mustang for hitting Mr. Palmer. Whether intentional or not, the wrongful death of Mr. Palmer falls into the standard California personal injury laws. Finding a good attorney and taking this case to court should be no problem for Mr. Palmer’s loved ones.</p>

Well, apparently you get $1.5 million. At least that’s what happened when a teacher in Arizona slipped on a puddle of water that was leaking out of a Coca-Cola refrigeration unit.</p>
<p>The woman initially sued Fry’s Food and Drug, the location where the slip and fall occurred. But after investigations were complete, it was discovered that the store had done everything within their power to get Coca-Cola to remove the machine and change it out for a new one prior to the accident. Since Coca-Cola ignored these pleas over a two-year period of time, it was determined that they were negligent, not to store.</p>
<p>In the end, the teacher sued for $149,000 and walked out of court with $1.5 million, the jury’s solution to the problem of her now chronic back pain. And Coca-Cola? Well, they tried to have the decision appealed but were denied. I hope this leads them to actually replacing the refrigeration unit at Frys.</p>

			<content:encoded><![CDATA[<p>A certain <a href="http://freeport.nassauguardian.net/national_local/319071914805611.php">industrial employee</a> is trying to raise awareness for industrial safety after he fell off a scaffolding structure and ended up in the hospital. According to reports, the man was climbing the scaffolding on March 29<sup>th</sup> of this year and had just reached the top when it collapsed, causing him to hit the ground and a few other things along the way.</p>
<p>While this man says he is lucky just to be alive, he does want to raise awareness amongst other industrial employees about the dangers of their field and the importance of safety gear. While he was wearing the full body suit required of him when he fell, he was not wearing a helmet or a safety harness, both of which could have saved him from further harm.</p>
<p>He also wants his employer and the other industrial companies in his area to focus more on the safety of their employees. His statements show that he doesn’t believe the scaffolding to be in good condition when he fell, claiming it collapsed out from underneath him. He also says that a lot of companies cut corners in safety in order to get the job done quickly and make more money. However, the company he works for claims that he simply slipped and fell off the scaffolding and that they have excellent safety measures in place.</p>
<p>This case has called several things into question, most of which are safety concerns for workers. There are clear laws in the state of California about worker safety and what gear should be worn, and industrial companies should do their best to ensure their employees have a safe working environment. If they don’t, there could be a lot of lawsuits in their future.</p>

			<content:encoded><![CDATA[<p>Janitors are often seen as the lowest man on the totem pole. Why? Well, they clean up after our messes. But I’ve always seen their profession as noble. A good janitor keeps a place sparkling clean and is willing to humble himself or herself when others are not. Talk about an amazing person.</p>
<p>However, apparently a group of high school students didn’t see this in the same light. How do I know? Because they are being sued… well, their parents are being sued for their actions anyway.</p>
<p>The janitor by the name of <a href="http://www.madisonrecord.com/news/234583-status-continued-to-june-in-janitors-suit-against-high-school-students-over-horseplay-injury">Keith Muskopf</a> is suing the parents of two boys who were “participating in horseplay” in the hallway when they slammed a door open… and directly into Mr. Muskopf’s shoulder. This action led to a serious shoulder injury, and Mr. Muskopf and his wife are suing because of it.</p>
<p>Do they have the right to sue? I think so. The negligence of these boys led to a serious injury, one in which a man with a janitor’s salary shouldn’t have to pay. But will the case hold up in court? I’m not so sure. After all, it’s hard to sue teenagers, and the parents are denying all wrongdoing because they were not present at the time of the accident. This could be a long battle for the Muskopf family.</p>

			<content:encoded><![CDATA[<p>Here is a story for you that still has me upset. My cousin, a law-abiding citizen with no track record of ever doing anything wrong, was arrested last week. Why was he arrested? Did he do something illegal? Was he caught in a drug smuggling scheme? Did he cuss out a police officer?</p>
<p>No. He didn’t do any other those things. In fact, the only thing he did do was walk down the sidewalk.</p>
<p>The cops on duty were chasing someone who had been involved in a drug bust a few blocks away. The man got away. But when the cops ran down the street after him, they came around a corner and ran right into my cousin. Instead of apologizing, they arrested him for assisting the druggie in his getaway!</p>
<p>Now, my cousin is a forgiving man. Even after they embarrassed him on the street, brought his wife in for questioning, and refused to release him for two days, he kept in good spirits. In his mind, it was all a big misunderstanding. When the police realized this, they let him go with their apologies and he was fine with that.</p>
<p>I, however, am not. I know that this <a href="http://www.ocinjuryattorney.com/personalinjury/false-imprisonment.php">wrongful arrest</a> could have ruined his career had his clients found out. I know that it worried his wife and cause him a lot of stress. If I were him, I would contact a personal injury attorney immediately and get the issue resolved with a monetary sum. After all, he deserves it. But for the moment, he is refusing any legal action. Maybe he just wants to forget the entire event ever happened.</p>

While there have been several cases over the last couple years involving accidents that occurred while operating the Yamaha Rhino, all the juries have agreed that <a href="http://www.mspnews.com/news/2011/04/04/5422982.htm">the Rhino</a> is safe if used correctly.</p>
<p>All new toys, regardless of size, come with instructions and safety information. Usually those warnings are thrown out or ignored because they are mostly common sense. But sometimes the safety regulations are vital to the toy’s operation.</p>
<p>That is the case with the Rhino. The Rhino is designed to be an off-road vehicle only and has many safety stipulations, like only allowing drivers over 16-years-old to operate them and wearing a safety helmet at all times. When these recommendations are ignored, accidents happen.</p>
<p>But just because an accident occurs doesn’t mean the manufacturer is at fault. In fact, according to several different court outcomes in the last two years, Yamaha isn’t responsible in the tiniest way for the accidents that occurred on the Rhinos purchased.</p>
<p>So, don’t worry about purchasing this product, but please follow the safety instructions to the letter.</p>

			<content:encoded><![CDATA[<p>When it comes to a contest between a 40-ton tractor-trailer hauling a full load of potatoes and three small commuter vehicles, the outcome is simple: the truck will always win. And that was the case when <a href="http://napervillesun.suntimes.com/news/4602436-418/24-million-award-upheld-in-fatal-crash.html">DeAn Henry</a> failed to stop on the I-95 in Illinois, causing a multi-car accident and killing two men.</p>
<p>While Henry pled guilty to the charges against her for the accident, she was only given 2 ½ years of probation and a suspended trucking license for two years. Not much of a price when you consider the loss of life and the injuries suffered by other drivers. However, in a personal injury suit that will be remembered, Henry and the trucking company were sued for almost $24 million, and the plaintiffs won.</p>
<p>Of course, the trucking company wanted nothing to do with that much of a loss and tried to appeal to a higher court. Their appeals failed. Now, the families of the innocent victims can finally receive the compensation they deserve. It’s about time.</p>

			<content:encoded><![CDATA[<p>Being a lawyer can be dangerous, especially if you have the wrong client. And while we hear reports about the unscrupulous tactics of lawyers all the time, I think it’s time to focus on the good lawyers who get punched in the face.</p>
<p>When <a href="http://www.abajournal.com/news/article/irked_at_his_lawyer_in_a_100_ticket_case_man_punches_her_in_face/">Gaylord Tootsie Daney</a> felt he wasn’t being represented well enough by his court appointed public defender, he did the only crazy thing that came to mind. He hit her so hard in the face that it sent her head crunching into the wall and broke her glasses. She sustained some pretty bad injuries and the public defenders office refused Mr. Daney further counsel.</p>
<p>So what had him so riled? Well, apparently it was a $100 fine for a marijuana charge. Now, personally, I think he proved the prosecutions’ case for them. After all, what kind of normal, not-on-drugs man is willing to punch out a government employee and spend two years in prison because he didn’t want to pay $100? Your honor, the prosecution rests.</p>

After all, they aren’t a victim or a family member, they have no vested stakes in seeing justice done or avoiding a lawsuit, and trials aren’t the best place to get your kicks.</p>
<p>However, I do think its sad when a perfectly legitimate case gets turned into a new spectacle because one of the jurors is famous.</p>
<p>Perhaps you know what I’m talking about. When <a href="http://www.mercurynews.com/peninsula/ci_17702754">Larry Ellison</a> fulfilled his civic duty and served on a jury panel for a slip and fall case, everyone was suddenly interested. However, no one seemed to care about the victim or the circumstances of the case. Instead, it was reported that the famous CEO was wearing “dark slacks and a black sweater.” Yes, because his personal wardrobe choice was more important than the victim of the case.</p>
<p>Honestly, I realize that the case was private and that court proceedings were not open to the media. Thank God! After all, if they were, I’m sure we’d have gotten less about the case and even more about Mr. Ellison’s facial expressions, whether or not he yawned, and speculation about how the company was running without him.</p>

			<content:encoded><![CDATA[<p>Okay, perhaps that title is a bit misleading, considering the fact that most attorneys have a bad name already simply because of their profession. However, when cases like that of <a href="http://articles.latimes.com/2011/mar/24/local/la-me-dole-20110324">Juan Dominguez</a> pop up in the news, scandal is spread over a much wider range than ever before.</p>
<p>I’m sure you heard in the news about this lawyer who was charged with inventing plaintiffs for a lawsuit in order to make money. According to then Los Angeles County Superior Court Judge Victoria G. Chaney, Mr. Dominguez found people who would pretend to be plaintiffs, coach them on what to say and how to act, and then fabricate evidence to support their claims.</p>
<p>In short, he committed fraud. In length, he created one more reason why every other hard-working American treats personal injury lawyers like pond scum.</p>
<p>So what are we to take from this case? Well, I’m not sure. In my opinion, this is an excellent example of why accident victims should take care when choosing an attorney to represent them in court. Nothing is worse than getting to court and discovering that the person you hired to represent you is held in zero esteem by the court or the state. If this happens, you might as well throw in the towel right away, for nothing said in that courtroom will be taken seriously.</p>
